Terms of Use
These Terms govern your use of Vireska. By creating an account or using the Service, you agree to them.
1. Acceptance of Terms
These Terms of Use ("Terms") are a binding agreement between you and Vireska, Inc. ("Vireska," "we," "us," or "our") governing your access to and use of the Vireska mobile application and website (together, the "Service"). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old, or the age of majority in your jurisdiction if higher, to create a Vireska account and use the Service. By using Vireska, you represent that you meet this requirement and that all information you provide to us is accurate.
3. Your Vireska Account
You may create an account using an email address and password, or by signing in with Apple or Google. You agree to provide accurate, current information and to keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at the contact address below if you believe your account has been accessed without your authorization.
4. The Vireska Service
Vireska is an AI-assisted fitness and nutrition coaching application. Through the Service, you can build and follow workout plans, log exercises and workouts, log meals and nutrition, track your body measurements and progress over time, chat with an AI Coach for personalized guidance, scan a food photo for an estimated nutrition breakdown, and — where you grant permission — view heart-rate data from Apple Health.
We may add, change, or remove features from the Service over time, as described in "Service Availability" below.
6. Subscriptions
Vireska offers two auto-renewing subscription plans: Vireska Monthly and Vireska Yearly (together, "Vireska Premium"). The price, currency, and billing period of each plan are displayed in the app and, for iOS, in the App Store product listing before you complete a purchase.
6.1 Billing and auto-renewal
On iOS, subscriptions are purchased and billed through Apple's In-App Purchase system to the Apple ID account you use on your device. Payment is charged at confirmation of purchase. Your subscription automatically renews for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for the plan. On Android or the web, where offered, subscriptions may instead be billed through Stripe on a recurring basis under substantially similar renewal terms disclosed at checkout.
6.2 Managing and canceling your subscription
You can manage or cancel an iOS subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions), independent of the Vireska app. Canceling stops future renewals but does not refund the current billing period; you retain Premium access through the end of the period you already paid for. A Stripe-billed subscription can be managed from the "Manage billing" option in the app's Settings screen.
6.3 Restore Purchases
If you reinstall the app or sign in on a new device, use "Restore Purchases" in Settings to re-link an existing, active subscription tied to your Apple ID (or Google account, where applicable) to your Vireska account, at no additional charge.
6.4 Entitlement verification
Your access to Premium features is verified by our backend against the subscription status reported by Apple, Google, or Stripe, as applicable — not by anything stored only on your device — so your entitlement stays accurate across app reinstalls and device changes.
7. AI Coach
The AI Coach is an automated, AI-generated chat feature that responds to your questions and provides fitness and nutrition guidance based on the information you provide. AI Coach responses are generated by an automated system and may be inaccurate, incomplete, generic, or not appropriate for your individual circumstances.
The AI Coach does not provide medical diagnosis or treatment and is not a substitute for professional medical advice. It is not an emergency service — if you are experiencing a medical emergency, contact your local emergency services immediately; do not rely on the AI Coach.
8. AI-Generated Workout Plans
Vireska can generate a personalized workout plan based on your profile, goals, equipment, and preferences using automated AI processing. AI-generated plans are provided for general fitness guidance and may not account for every aspect of your physical condition, injury history, or limitations. Review any AI-generated plan critically, adjust it as needed, and consult a qualified professional before starting a new exercise program, particularly if you have an injury or medical condition.
9. AI-Generated Nutrition Plans
Vireska can generate a personalized nutrition plan based on your profile, goals, and dietary preferences using automated AI processing. AI-generated nutrition plans are provided for general informational purposes, may not account for allergies, medical conditions, or nutrient interactions with medication, and are not a substitute for advice from a registered dietitian or physician.
10. Nutrition Scan
Nutrition Scan estimates the nutritional content of a meal from a photo you submit, using automated AI image analysis. These estimates are approximate and may be materially incorrect — food-recognition and portion-size estimation from a single photo has inherent limitations. Verify important nutrition information yourself (for example, from packaging or a nutrition database) before relying on it for medical, allergy, or strict dietary decisions.
11. Health and Fitness Disclaimer
Vireska is a fitness and wellness application. It is not a healthcare provider, and using Vireska does not create a doctor-patient or any other clinical relationship.
Information and recommendations provided through the Service — including workout plans, nutrition plans, nutrition estimates, and AI Coach responses — are for general informational and fitness/wellness purposes only. They are not medical advice, diagnosis, or treatment, and should not be relied upon as such.
Consult an appropriately qualified healthcare professional before beginning or changing an exercise, nutrition, or wellness program, particularly if you have a medical condition, an injury, are pregnant, take medication, or have other health concerns. Stop any activity immediately if you experience pain, dizziness, or discomfort.
Vireska is not designed or intended for use in a medical emergency. If you believe you are experiencing an emergency, contact your local emergency services immediately.
12. User Responsibilities
You are responsible for the accuracy of the information you provide to Vireska, for exercising your own judgment when following any guidance the Service provides, and for your own safety while performing any exercise or following any nutrition guidance.
13. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to disrupt, overload, or impair the Service or its infrastructure;
- Attempt to access another user's account or data, or to circumvent any access control, rate limit, or entitlement check;
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except to the extent applicable law expressly permits;
- Use the Service to submit content that is unlawful, harassing, or infringes the rights of others;
- Use automated means (bots, scrapers) to access the Service outside of the app's own client, except as we may separately authorize.
14. User Content
You retain ownership of the content you submit to Vireska — your profile information, workout and nutrition logs, AI Coach messages, and photos (including meal photos and chat attachments) ("User Content"). By submitting User Content, you grant us a limited license to store, process, and display it back to you, and to transmit it to the service providers described in our Privacy Policy (such as our AI provider), solely to operate and provide the Service to you.
You are responsible for ensuring you have the right to submit any photo or content you upload, and for not submitting content that violates the rights of any third party.
15. Intellectual Property
The Vireska name, logo, app, website, and underlying software and content (excluding User Content) are owned by Vireska, Inc. or our licensors and are protected by intellectual-property laws. Except for the limited right to use the Service as intended, these Terms do not grant you any right, title, or interest in our intellectual property.
16. Third-Party Services
The Service relies on third-party providers — including Supabase, Google (Gemini API, Google Sign-In), Apple (Sign in with Apple, App Store, HealthKit), RevenueCat, Stripe, PostHog, Resend, and MuscleWiki (exercise demonstration videos) — described in more detail in our Privacy Policy. We are not responsible for the acts or omissions of these third-party providers, though we select and configure them to support the Service securely.
Vireska's Workout feature includes exercise demonstration videos alongside AI-generated workout plans, provided by MuscleWiki. This content remains subject to MuscleWiki's own terms and licensing requirements — Vireska does not claim ownership of it, and MuscleWiki does not endorse Vireska. See "Third-Party Licenses" below for the required attribution.
17. Third-Party Licenses
The Service incorporates content and services from the following third-party provider under its own license terms:
17.1 MuscleWiki
Vireska uses exercise data and exercise demonstration videos provided by MuscleWiki through its API. Exercise data and videos provided by MuscleWiki.com. This content is proprietary to MuscleWiki (not open-source or public-domain) and remains subject to MuscleWiki's own terms and licensing requirements, available at the link below. Vireska does not claim ownership of MuscleWiki-provided content, and this reference does not imply that MuscleWiki endorses Vireska.
18. Privacy Policy
Our collection and use of your personal information is described in our Privacy Policy, available at /privacy, which is incorporated into these Terms by reference.
19. Service Availability
We are continuously developing Vireska. Features may be added, changed, limited, or removed, and the Service may be temporarily unavailable for maintenance, updates, or reasons outside our control. We do not guarantee uninterrupted or error-free operation of the Service.
20. Disclaimers
THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC CIRCUMSTANCES.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRESKA, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
22. Suspension and Termination
We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or to protect the security or integrity of the Service. You may stop using the Service at any time. Termination of your access does not entitle you to a refund of any subscription fee already paid, except where required by Apple's, Google's, or applicable law's own refund policies.
23. Account Deletion
You may permanently delete your account at any time from Profile → Settings → Delete Account in the app. Deletion is immediate and permanently removes your account and the data associated with it, as described in our Privacy Policy. Deleting your account does not automatically cancel an active Apple or Google subscription — cancel it separately through your Apple ID or Google account settings if you do not wish it to renew.
24. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice in the app. Your continued use of the Service after a change takes effect constitutes your acceptance of the updated Terms.
25. Governing Law
These Terms are governed by the laws applicable to Vireska, Inc.'s place of business in the United States, without regard to conflict-of-laws principles, except where the mandatory consumer-protection laws of your country or state of residence require the application of different law.
